Former Chief Secretary faces additional misconduct charge

A former Chief Secretary for Administration, who was earlier charged by the ICAC with bribery and misconduct offences involving payments and unsecured loans, was today (Friday) laid with an additional misconduct charge when he appeared at Eastern Magistracy.
Hui Rafael Junior, also known as Rafael Hui Si-yan, 65, also a former Non-Official Member of the Executive Council (Exco), faced an additional charge of misconduct in public office, contrary to Common Law.
Four other co-defendants were Thomas Kwok Ping-kwong, 61, Raymond Kwok Ping-luen, 59, both Joint Chairmen of Sun Hung Kai Properties Limited (SHKP); Chan Kui-yuen, 66, Executive Director of SHKP; and Kwan Francis Hung-sang, 62, businessman.
All five defendants now faced a total of eight charges, including the additional charge of misconduct in public office laid against Hui today.
The other seven charges were one of conspiracy to offer advantages to a public servant, contrary to Section 4(1)(a) of the Prevention of Bribery Ordinance and Section 159A of the Crimes Ordinance; two of misconduct in public office and three of conspiracy to commit misconduct in public office, contrary to Common Law; and one of furnishing false information, contrary to Section 19(1)(b) of the Theft Ordinance.
The additional charge alleged that between July 1, 2007 and January 20, 2009, Hui, being a Non-Official Member of the Exco, in the course of or in relation to his public office, without reasonable excuse or justification, wilfully misconducted himself by failing to declare or disclose to, or by concealing from, the Government of the Hong Kong Special Administrative Region his receipt of HK$11.182 million through a series of payments from Chan and Kwan.
Meanwhile, Hui and Raymond Kwok had an original charge of conspiracy to offer advantages to a public servant against them withdrawn.
The defendants all pleaded not guilty to the charges. Magistrate Li Kwok-wai committed the case to the Court of First Instance for trial and extended the defendants’ bail on the same terms.
The prosecution was today represented by Director of Public Prosecutions Kevin Zervos, SC and Acting Senior Assistant Director of Public Prosecutions Winnie Ho, assisted by ICAC officer Hazel Law.
