Salesman in court for allegedly offering $100,000 illegal rebates

A senior salesman of an authorised dealer of a Japanese brand of trucks appeared at the Kowloon City Magistracy today (Thursday) after being charged by the ICAC with conspiracy to offer over $100,000 in illegal rebates to an employee of a client in relation to the sale of trucks.
Mak Kin-kon, 60, a senior sales executive of Triangle Motors Limited (TML), who was charged on Tuesday (June 4), faced one count of conspiracy to offer an advantage to an agent, contrary to Section 9(2)(a) of the Prevention of Bribery Ordinance and Section 159A of the Crimes Ordinance.
No plea was taken today. Principal Magistrate Mr Clement Lee Hing-nin adjourned the case to July 5 for plea.
At all material times, the defendant was a senior sales executive of TML, a subsidiary of the listed Dah Chong Hong Holdings Limited and an authorised dealer of a Japanese brand of trucks.
The charge alleged that between January 2009 and December 2010, the defendant conspired together with the proprietor of a car body building factory to offer sums of money to a director of a transportation company as rewards for entering into a contract with TML for the sale and purchase of 10 trucks of the brand.
The sums of money, which were suspected illegal rebates, amounted to over $100,000.
The defendant was granted cash bail of $40,000. He was also ordered to surrender his travel documents, not to leave Hong Kong and not to interfere with prosecution witnesses.
The prosecution was today represented by ICAC officer Edwin Tsang.
