Ex-MAC chairman sentenced for bribery

A then chairman of a mutual aid committee (MAC) at a public housing estate, charged by the ICAC, was today (Monday) sentenced at the Kwun Tong Magistracy for accepting 10 packs of cigarettes being a bribe from a security guard in relation to the latter’s job posting.
Wong Yiu-lam, 48, then chairman of a MAC at Sau Mau Ping Estate (SMP Estate), was ordered by Deputy Magistrate Kennis Tai Chiu-ki to perform 180 hours of community service.
The defendant was earlier ordered by the deputy magistrate to make a restitution of $390 to the Government after being found guilty of one count of agent accepting an advantage, contrary to Section 9(1)(b) of the Prevention of Bribery Ordinance (POBO).
The court heard that at the material time, the defendant was the chairman of the MAC of Sau Yee House (SYH) at SMP Estate, a public housing estate managed by the Housing Department.
Lam Yung-biu, a security guard, was deployed to patrol around SYH by a property services company, which provided management and security services to SMP Estate.
On a day in July 2010, Lam had a dispute with his supervisor. Lam was afraid of being posted to another location, so he gave 10 packs of cigarettes to the defendant as a reward for exercising his influence to retain Lam’s job posting.
The defendant agreed to liaise with Lam’s supervisor, still Lam was later dismissed by the property services company. Upon Lam’s enquiry, the defendant said he had contacted the management of the company, but was unable to help Lam, the court was told.
Lam, 65, who was also charged by the ICAC, earlier pleaded guilty to one count of offering an advantage to an agent, contrary to Section 9(2)(b) of the POBO. He was ordered to perform 100 hours of community service and fined $5,000.
The prosecution was today represented by Senior Public Prosecutor Jones Tsui, assisted by ICAC officer Guys Wong.
