Job seeker charged with obtaining employments with property agencies by deception
2018-11-15
A man has been charged by the ICAC with obtaining employments with two property agencies by using false representations and academic proofs, thereby inducing the property agencies to pay him salaries totalling over $34,000.
Au Kam-cheong, 21, who was charged yesterday (November 14), faces three charges of obtaining a pecuniary advantage by deception, contrary to Section 18(1) of the Theft Ordinance.
The defendant will appear at the Shatin Magistracy tomorrow (November 16) for plea.
The case arose from a corruption complaint. Subsequent ICAC enquiries revealed the above alleged offences.
One of the charges alleges that between November 1 and 30, 2015, the defendant dishonestly obtained for himself an opportunity to earn remuneration in the employment with Ricacorp Properties Limited (Ricacorp) by falsely representing to a then branch manager of Ricacorp that he had completed Form 5 secondary education, and on the employment application form that he had completed Form 3 education at a secondary school in Hong Kong.
Another charge alleges that between March 2 and April 18, 2016, the defendant dishonestly obtained for himself an opportunity to earn remuneration in the employment with Ricacorp by falsely representing that he had completed Form 6 education at another secondary school in Hong Kong, and submitting to Ricacorp a forged graduation certificate which purported to be issued by that secondary school.
The remaining charge alleges that between March 23 and July 7, 2017, the defendant dishonestly obtained for himself an opportunity to earn remuneration in the employment with Centaline Property Agency Limited (Centaline) by falsely representing that he had completed Form 5 education at the above-mentioned secondary school and had never been found guilty of any offence in Hong Kong, and submitting to Centaline a forged graduation certificate which purported to be issued by that secondary school.
ICAC enquiries revealed that the defendant had only studied Form 1 at two secondary schools.
As a result of alleged false representations and academic proofs, the defendant was employed by Ricacorp and Centaline to work as sales trainee, thereby inducing Ricacorp and Centaline to pay him salaries of over $11,200 and $22,800 in total respectively.
Ricacorp and Centaline have rendered full assistance to the ICAC during its investigation into the case.
The defendant has been released on ICAC bail, pending his court appearance tomorrow.
