Construction company staff charged with bribery over renovation project

A staff of a construction company has been charged by the ICAC today (November 16) with bribing the chairlady of the incorporated owners (IO) of a residential building in Tai Kok Tsui in securing a renovation project of the building.

Ng Wan-kui, 44, clerk of Chi Fu Construction (Group) Limited (Chi Fu), faces two counts of offering an advantage to an agent, contrary to Section 9(2)(a) of the Prevention of Bribery Ordinance. The alleged bribes included a promise to waive the IO chairlady’s share of renovation fee in the project and a commission equivalent to five per cent of its contract sum.

The defendant will appear at the West Kowloon Magistracy next Tuesday (November 20) for plea.

The case arose from a corruption complaint referred by the Competition Commission. Subsequent ICAC enquiries revealed the above alleged offences.

At the material time, the defendant approached the chairlady of the IO of a residential building in Canton Road, Tai Kwok Tsui, which was required to conduct a renovation project.

One of the charges alleges that on December 14, 2017, the defendant, without lawful authority or reasonable excuse, offered an advantage, namely a promise to waive the renovation fee payable by the IO chairlady for the unit owned by her at the residential building, to the IO chairlady as a reward for assisting either of two architectural firms to be appointed by the IO as the consultant of its renovation project and assisting Chi Fu or the contractor which was related to him to be appointed by the IO as the contractor of its renovation project.

The other charge alleges that on December 28, 2017, the defendant, without lawful authority or reasonable excuse, offered an advantage, namely a commission equivalent to five per cent of the contract sum of the renovation project, to the IO chairlady as a reward for assisting the contractor which was related to him to be appointed by the IO as the contractor of the renovation project.

The IO of the residential building has rendered full assistance to the ICAC during its investigation into the case.

The defendant has been released on ICAC bail, pending his court appearance next Tuesday.
