Defeated candidate of EC Subsector Elections charged with failing to lodge election return

A defeated candidate of the Architectural, Surveying, Planning and Landscape Subsector of the 2016 Election Committee (EC) Subsector Elections has been charged by the ICAC today (January 2) with failing to lodge an election return as required by the Elections (Corrupt and Illegal Conduct) Ordinance (ECICO).
Man Chi-chuen, 54, quantity surveyor, faces one count of failing to lodge an election return as required under Section 37 of the ECICO, contrary to Section 38(1)(a) of the ECICO.
The defendant will appear at the Kwun Tong Magistracy next Monday (January 6) for plea.
The case arose from a referral by the Registration and Electoral Office (REO). Subsequent ICAC enquiries revealed the above alleged offence.
The defendant was a candidate of the Architectural, Surveying, Planning and Landscape Subsector of the 2016 EC Subsector Elections held on December 11, 2016, and he was defeated. The statutory deadline for submission of his election return to the REO was on or before January 14, 2017.
The charge alleges that on January 14, 2017, the defendant, being a candidate at the 2016 EC Subsector Elections for the Architectural, Surveying, Planning and Landscape Subsector, failed to lodge an election return as required by the ECICO.
The REO has rendered full assistance to the ICAC during its investigation into the case.
The defendant has been released on ICAC bail, pending his court appearance next Monday.
