Amenities Assistant of LCSD charged with soliciting and accepting unauthorised loans and bribe

An Amenities Assistant I of the Leisure and Cultural Services Department (LCSD) has been charged by the ICAC today (June 5) with soliciting and accepting unauthorised loans and a bribe totalling over $9,000 from two co-workers under his supervision.
Luk Kin-fan, 57, faces two counts of prescribed officer soliciting and accepting an advantage, and five counts of prescribed officer soliciting an advantage, all contrary to Section 3 of the Prevention of Bribery Ordinance (POBO).
The defendant further faces one count of public servant soliciting an advantage, contrary to Section 4(2)(a) of the POBO.
The defendant will appear at the Eastern Magistrates’ Courts next Tuesday (June 9) for plea.
The case arose from a corruption complaint referred by the LCSD. Subsequent ICAC enquiries revealed the above alleged offences, which took place between August 2018 and May 2019.
At the material time, the defendant was an Amenities Assistant I of the LCSD posted to Lei Yue Mun Park. He was responsible for supervising cleaning and maintenance work of the park, including cleaning work conducted by cleansing workers of the park’s cleaning contractor.
The defendant also held a supervisory role over the duties of an Acting Amenities Assistant II (AAII) of an adjacent team if they worked on the same shift when the latter’s supervisor was not on duty.
Two of the charges allege that the defendant, without the general or special permission of the Chief Executive (CE), solicited and accepted two loans of $2,000 and $5,000 respectively from the Acting AAII and a cleansing worker of Lei Yue Mun Park’s cleaning contractor.
Five other charges allege that the defendant, without the general or special permission of the CE, solicited three other loans totalling over $2,000 from the aforesaid Acting AAII on three occasions, and a loan of a few hundred dollars from the abovementioned cleansing worker on each of two other occasions.
The remaining charge alleges that the defendant, without lawful authority or reasonable excuse, solicited a loan of a few hundred dollars from the Acting AAII as a reward for assisting the latter in securing a favourable staff report.
The LCSD has rendered full assistance to the ICAC during its investigation into the case.
The defendant has been released on ICAC bail, pending his court appearance next Tuesday.
