Defendants
D1: Chief Technical Officer, Highways Department
D1 joined the Highways Department as Foreman in 1977 and was promoted to Chief Technical Officer on 30 July 2012 with a monthly salary of about HK$80,000. At the material time, D1 was Chief Technical Officer of Kwun Tong District under Highway Maintenance of the Kowloon Regional Office.
D2: Subcontractor
D2, the director-cum-shareholder of the following engineering companies, was also the subcontractor hired by Contractor S for the provision of labour and materials for works under term contracts at different periods:
Company A
D2 held
Mr Z held
D2 was Company A's director between 23 June 2012 and 27 March 2014. He and another director Mr Z each held 50% of the shares of Company A. On 27 March 2014, 4,900 shares and 100 shares held by him were transferred to Mr X and Mr Z respectively.
Company B
D2 held
Mr Z held
D2 was Company B's director between 11 June 2012 and 11 June 2016. He and another director Mr Z each held 50% of the shares of Company B.
Company C
D2 held
Mr X held
D2 was Company C's director between 29 July 2012 and 29 July 2016. He and another director Mr X each held 50% of the shares of Company C.
Company D
D2 held
Mr X held
D2 was Company D's director between 31 March 2012 and 12 December 2015. He and another director Mr X each held 50% of the shares of Company D.
